Instruccionarte legal notice: who we are and what it covers
This is a courtesy translation. In case of any discrepancy, the Spanish version prevails.
This legal notice sets out the terms of use of this website and the general terms of the services offered by Instruccionarte, a brand operated by GRUPO DE SOLUCIONES CREATIVAS S.A.C., with RUC (Peruvian taxpayer ID) 20607431117 and registered address at Las Almendras 286, Lima, Perú.
By browsing the website or contracting a service, you accept these terms. Each project is also governed by its accepted quote or proposal; if the two differ, what was agreed in the proposal prevails. You can contact us at contacto@instruccionarte.com or at +51 935 078 563.
Use of the website and its content
You may browse, read and share the content of this website for informational purposes, citing the source. You may not:
- Copy or reproduce texts, designs, demos or samples for commercial purposes without written authorization.
- Use the website or its forms to send spam, unlawful content or malicious software.
- Attempt to access restricted areas or interfere with the operation of the site.
The texts, design, logos and samples published belong to Instruccionarte or are used under license. Blog articles are for guidance only and do not replace specific professional advice. Links to third-party sites are provided for reference and do not imply any responsibility for their content.
Quotes and proposals
Each service is quoted in a document that describes the scope, deliverables, estimated timeline, number of revision rounds and payment terms.
- Validity: the quote is valid for the period stated in it. After that period, we may update prices and dates.
- Scope: it only includes what is described. Anything not listed is quoted as an add-on.
- Acceptance: the project begins upon written acceptance of the proposal and payment of the agreed initial installment.
Prices, IGV and payment terms
Prices published on the website, such as those of the SCORM course packages, are for reference and include IGV (Peru's sales tax). The final price is confirmed in the quote based on your material, the scope and the timeline.
Payment terms are stated in each proposal; for example, a percentage up front and the balance upon delivery. We issue electronic receipts (boleta) or invoices (factura). Late payments may suspend the schedule until they are settled.
Client responsibilities: content and validation
The client is the subject-matter expert and is responsible for:
- Delivering the complete source material within the agreed deadlines.
- Holding the rights to the texts, images, videos, trademarks and data it provides.
- Validating the technical, legal and regulatory accuracy of the content, especially in courses on occupational health and safety, sexual harassment or other regulated topics.
- Appointing a person to approve scripts and deliverables.
- Providing the necessary access to its LMS for testing, where applicable.
Instruccionarte provides instructional design, production and pedagogical review, but does not replace validation by the client's specialists.
Revisions, scope changes and timelines
Each proposal states how many revision rounds are included per stage, for example one for the script and another for the produced course. A round is a single consolidated submission of feedback.
Additional rounds and scope changes, such as adding slides or rewriting an already approved script, are quoted separately. Timelines are counted from the complete delivery of the source material and are extended when the client's validations or payments are delayed.
Intellectual property of deliverables
Once full payment for the project has been made, the client obtains the rights to use and exploit the final deliverables custom-produced for it, such as the course, videos or infographics, for its organization's purposes.
- Until full payment, the deliverables remain the property of Instruccionarte and may not be published.
- Content provided by the client remains the client's at all times.
- Instruccionarte retains its generic templates, methods, reusable components and prior know-how.
- Third-party resources, such as fonts, stock images or music, and authoring tools, are governed by their own licenses.
- Source files are delivered when the proposal so states.
We will only show a project in our portfolio if the client authorizes it in writing.
Use of artificial intelligence in voices, images and text
In some services we use artificial intelligence tools, and we disclose this in the proposal. For example, AI-generated voice-over, subtitles, supporting images or illustrations, and text drafts.
Everything generated with AI goes through human review by our team and validation by the client. We do not use voices that imitate real people without their authorization. If you prefer professional human voice-over or 100% custom illustrations, we quote them as an add-on. Learn more about our artificial intelligence services.
Confidentiality and limitation of liability
We treat the internal information you share with us as confidential and process personal data in accordance with our privacy policy.
We provide our services with the diligence of a specialized provider. To the extent permitted by law, Instruccionarte is not liable for:
- Errors in content approved by the client.
- Failures, configurations or changes in the client's or third parties' LMS platform.
- Learning outcomes that depend on the client's implementation, communication or follow-up.
- Indirect damages or loss of profits.
In any case, our liability is limited to the amount paid for the service that gave rise to the claim.
Libro de Reclamaciones (Complaints Book), governing law and amendments
We make an online Libro de Reclamaciones (Complaints Book) available to you, in accordance with the Código de Protección y Defensa del Consumidor (Peru's Consumer Protection and Defense Code).
These terms are governed by the laws of the Republic of Peru. Any dispute will first be attempted to be resolved directly and in good faith; failing that, it will be submitted to the competent judges and courts of Peru, without prejudice to consumer rights. We may update this legal notice; the version in force is the one published on this page and does not affect projects already contracted.
