Instruccionarte privacy policy: what it is and who it applies to
This is a courtesy translation. In case of any discrepancy, the Spanish version prevails.
This privacy policy explains how we process the personal data of people who visit our website, request a quote, subscribe to the newsletter, file a complaint or contract our instructional design and e-learning production services.
It has been prepared with reference to Law No. 29733, Ley de Protección de Datos Personales (Peru's Personal Data Protection Law), and its regulations in force. We process your data in accordance with the principles of legality, consent, purpose, proportionality, quality, security and transparency. We recommend reviewing the regulations in force if you need the legal details.
Owner of the personal data banks
The owner of the data banks and the controller of the processing is GRUPO DE SOLUCIONES CREATIVAS S.A.C., with RUC (Peruvian taxpayer ID) 20607431117 and registered address at Las Almendras 286, Lima, Perú, the company that operates the Instruccionarte brand.
We manage, among others, the data banks of clients, prospects and contacts, newsletter subscribers and complaint handling. For any privacy inquiry, email us at contacto@instruccionarte.com with the subject line “Personal data protection”.
What personal data we collect
We collect only the data necessary for each purpose:
- Contact and quote forms: name, job title, organization, email, phone or WhatsApp number, and the description of your project.
- Newsletter: your email and, if you provide it, your name.
- Contracting and billing: RUC or identity document, legal name, tax address and the details needed to issue receipts and invoices.
- Libro de Reclamaciones (Complaints Book): the data required by its regulations, such as identity, address, contact details and details of the claim or complaint.
- Browsing data: technical and website usage information obtained through cookies, according to your settings.
- Communications: email and WhatsApp messages and project meeting minutes.
We do not request sensitive data. We ask that you not include it in forms or messages unless it is essential.
Purposes and legal basis for processing
We use your data for the following purposes:
| Purpose | Legal basis |
|---|---|
| Answering inquiries and preparing quotes | Your request and pre-contractual measures |
| Carrying out the contracted project, coordinating revisions and deliveries | Contractual relationship |
| Issuing receipts and invoices and complying with tax obligations | Legal obligation |
| Handling claims and complaints | Legal obligation under consumer protection law |

Commercial purposes are optional. If you do not accept them, you can still request quotes and contract our services.
Newsletter and commercial communications
If you subscribe to the newsletter, we will send you blog articles, guides and news about our services. Each email includes a link to unsubscribe with one click.
We may measure opens and clicks in aggregate to improve the content. You can also withdraw your consent by writing to contacto@instruccionarte.com.
Materials and data you share with us during a project
During a project you may provide us with manuals, procedures, presentations, recordings, logos or access to your LMS platform. We use that material only to produce and test the contracted deliverables, and we treat it as confidential information.
If the material includes personal data of your employees, students or third parties, for example names on a list, photographs or voices, your organization is the controller of that processing and is responsible for obtaining the necessary authorizations. Instruccionarte acts as a processor: it does not use that data for its own purposes and deletes or returns it when the project closes, unless the law requires it to be retained.
We recommend anonymizing the examples and cases you send us when it is not necessary to identify individuals.
Retention periods
We keep data only for as long as necessary:
- Inquiries and quotes not accepted: for a limited period in order to follow up on them.
- Client and project data: for the duration of the relationship and, afterwards, for the time needed to handle warranties or liabilities.
- Receipts, invoices and accounting records: for the period required by tax regulations.
- Claims and complaints: for the period established by the Libro de Reclamaciones regulations.
- Newsletter: until you unsubscribe.
Once those periods expire, we securely delete or anonymize the data.
Transfers and data processors
We do not sell personal data. We only share it with providers needed to deliver the service, under confidentiality and security commitments:
- Web hosting, email and cloud storage services.
- Newsletter delivery and messaging platforms.
- Analytics and advertising tools, only if you accept their cookies.
- E-learning production and artificial intelligence tools, only with the content needed to produce your course.
- Electronic invoicing providers and authorities, when there is a legal mandate.
Some of these providers are located outside Peru, which involves a cross-border flow of data. We do this within the framework of Law No. 29733, seeking to ensure that the recipient offers adequate levels of protection.
Your ARCO rights and how to exercise them
As the owner of your data, you have the following rights, known in Peru as ARCO rights:
- Access: to know what data of yours we process and who we share it with.
- Rectification: to correct inaccurate or incomplete data.
- Cancellation: to request the deletion of your data when it is no longer needed, unless the law requires it to be retained.
- Objection: to object to a specific processing activity, such as receiving advertising.
You may also revoke your consent at any time. To exercise your rights, write to contacto@instruccionarte.com with the subject line “ARCO rights” and include your name, a copy or reference of your identity document, the right you wish to exercise and an email address for our reply. We will handle your request within the time limits set by the regulations. If you believe it was not handled properly, you may contact the Autoridad Nacional de Protección de Datos Personales (Peru's National Personal Data Protection Authority).
Information security
We apply reasonable technical and organizational measures to protect data: encrypted connections, role-based access, strong passwords, backups and confidentiality commitments with our team and providers.
Any access to your LMS that you share with us is used only during the project. We recommend creating a temporary user for us and deactivating it at closing. If an incident affecting your data were to occur, we will act to contain it and will inform you when appropriate.
Minors, cookies and changes to this policy
Our services are aimed at companies, institutions and adults, and we do not intentionally collect data from minors. If an educational institution shares materials with student data with us, it is responsible for obtaining the authorizations required by the regulations.
Our website uses first-party and third-party cookies. You will find the details in the cookie policy and the other terms in the legal notice. We may update this policy due to legal changes or changes in our services; we will always publish the version in force on this page.
